OSH ACT of 1970 Section (5)(a)(1): 29 CFR Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized electrical hazards that were causing or likely to cause death or serious physical harm. Location: Eversource underground vault TNV 675A at Bowdoin St, Boston, MA On or about July 12, 2022, employees were exposed to electrical hazards, including arc flash, arc blast, burns and smoke inhalation. Or, in the alternative: 29 CFR 1910.269(l)(8)(v):The employer did not ensure that each employee exposed to hazards from electric arcs wore protective clothing and other protective equipment that had an arc rating greater than or equal to the heat energy estimated under paragraph (l)(8)(ii) of this section whenever that estimate exceeded 2.0 Cal/cm2.
