29 CFR 1910.219(e)(4):Vertical belts running over a lower pulley more than seven (7) feet above floor or platform were not guarded at the bottom in the same manner as horizontal overhead belts, if conditions are as stated in paragraphs (e)(2)(ii) (a) and (c) of this section: (a)Protective Coating Specialists, Inc. at 1350 7th Street Northwest, Huron, SD 57350: On or about and at times prior to November 22, 2023, the employer did not ensure that employees performing work in the vicinity of the Polarcool Evaporative Cooler on the South Line were protected from ingoing nip points in that the belt and pulley were unguarded on the intake side of the cooler. This condition exposed employees to ingoing nip point hazards. (b)Protective Coating Specialists, Inc. at 1350 7th Street Northwest, Huron, SD 57350: On or about and at times prior to November 22, 2023, the employer did not ensure that employees performing work in the west end of the Main Line Alley were protected from ingoing nip points in that a belt and pulley were unguarded associated with the terminal wash stations of the line. This condition exposed employees to ingoing nip point hazards.
