29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (The requirements of 29 CFR 1910.134 are applicable to construction per 29 CFR 1926.103) Employer is failing to provide a medical evaluation for employees required to use N-95 filtering facepiece respirators during jobs such as cutting of concrete that create potential silica exposure. This hazard last occurred on August 17, 2018 at a job site located at 17660 Wright St. Omaha, NE 68138.
