Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to tip over hazards while operating fork lift trucks and not wearing the seat belts equipped on the fork lift trucks. Warehouse The employer did not ensure that the fork lift operators were wearing their seat belts at all times while operating the fork lift trucks. One feasible abatement method among others would be to ensure the employees wear the seat belts at all times while operating the fork lift trucks.ng
