29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. a) 43 Somerset Lane, Newark, DE: On or about July 8, 2020, the employer's failed to shore an area and personal sampling of employee(s) who were determined to have been working in a hazardous environment, approximately eight feet deep and four feet wide, resulting in an employee collapsing while applying a hazardous chemical sealant to a wall. An employee was hospitalized due to not providing the necessary personal protective system or equipment to be used and/or worn by employees.
