29 CFR 1917.71(e): Employees working in the immediate area of container handling equipment or in the terminals traffic lanes did not wear high visibility vest or equivalent protection: a) 5080 McLester Street, Southeast end of Row #503, Elizabeth, NJ 07207. Employee, while traversing a container handling area and in the terminals traffic lanes was not wearing a high visibility vest that met the requirements of the APM Personal Protective Equipment Policy nor the requirements set forth by ANSI, Class 2 Standards exposing the employee to struck-by hazards. Note to paragraph (e): High visibility vests or equivalent protection means high visibility/retro-reflective materials which are intended to make the user clearly visible by day through the use of high visibility (fluorescent) material and in the dark by vehicle headlights through the use of retro-reflective material. For example, an acceptable area of material for a vest or equivalent protection is .5 m2 (760 in2 ) for fluorescent (background) material and .132 (197 in2 ) for retro-reflective material. Vests or equivalent protection, such as high visibility/retro-reflective coveralls, that are available for industrial use, may also be acceptable. Incident occurred on or about 08/07/15.
