29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) On December 10, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, employees were working from a scaffold platform at twelve and one half feet above surface level without utilizing conventional fall protection equipment on the gable end of the garage. b) On December 10, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, employees were working from a scaffold work platform at eleven and one half feet above surface level without utilizing conventional fall protection equipment on the gable end of the garage. c) On or about December 8, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, employees were working from scaffold planks at greater than ten feet above surface level without utilizing conventional fall protection equipment on the long sides of the garage.
