29 CFR 1926.651(g)(1)(iii): Adequate precautions were not taken such as providing ventilation, to prevent employee exposure to an atmosphere containing a concentration of a flammable gas in excess of 20 percent of the lower flammable limit of the gas: a) 43 Somerset Lane Newark, DE: On or about July 8, 2020, the employer did not ensure precautions were taken to provide and use engineering controls [e.g. exhaust ventilation] for employee(s) who are tasked with entering into a trench to apply a chemical sealant, which contained chemical components Toluene and Tetra -Butyl Acetate, which was determined to have off-gassed and cause the employee to faint and later hospitalized.
