29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) Warehouse and Yard: Employees used forklifts to lift, transfer, and dump metal hoppers, and the employer did not receive written approval from the forklifts' manufacturers prior to operating the forklifts with these hopper attachments, on or about August 14, 2024. ABATEMENT CERTIFICATION REQUIRED ABATEMENT NOTE: If no response or a negative response from the powered industrial truck manufacturer is received upon requesting their written approval for the attachments, the employer may obtained a written approval from a qualified Registered Professional Engineer. If the manufacturer's response was negative, then the engineer, prior to granting approval for the modification or addition, would need to perform a safety analysis and address all safety and/or structural issues contained in the manufacturer's disapproval.
