29 CFR 1926.600(a)(6)(iv): A person was not designated to observe clearance of the equipment and give timely warning for all operations where it is difficult for the operator to maintain the desired clearance by visual means: (a) 520 Valentine Lane Bellefonte PA New Residential Homes- Employees were excavating a trench under energized power lines and did not designated an employee to observe clearance from the power lines to the Case 300-D excavator, exposing employees to electrical hazards, on or about October 25, 2021. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
