Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of electrocution. (a) On or about May 3, 1994 an employee of Smith Dairy located at 6345 County Rd. 33, Yuma, CO. was fatality electrocuted while using a 120 volt 1/2 drive Milwaukee brand drill to install a fence next to the "maternity barn". Investigation results conclude that an unused portion of the metal electrical box was not enclosed in that a "knockout" was missing. A feasible way of abating this hazard is to follow the National Electrical Code book, paragraph 370-18 or 11012(a) and effectively close all unused portions of electrical boxes.
