29 CFR 1910.29(b)(1): 29 CFR 1910.29(b)(1): T he employer did not ensure that guardrail systems met the requirement that the top edge height of top rails, or equivalent guardrail system members, that are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D11 of this section). At a worksite located at 2915 Nicholson Ave, Kansas City, Missouri. Employees working on the chemical mixing platform were exposed to serious fall hazards into large tanks of caustic chemicals approximately 2000-4000 gallons in volume from smallest to largest capacity. Employees were also exposed to a fall at heights of approximately 9-10 feet to the concrete floor below. Safety/ guard rails extended 26 inches above the walking working surface.
