29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace: a) On or about October 29, 2024 - Kamesi Corporation - 111 E 100th St Apt 2B, New York, NY 10029 Employees performing bathtub refinishing are required to wear respirators including but not limited to 3M half-face respirator while using hazardous chemicals including but not limited to Hoodstrip-888 Semi-Paste Remover, which contains 75-90% Methylene Chloride (MC). The employer did not provide employees with medical evaluations to assess their ability to use a respirator. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19
