North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush by hazards: a)Facility - Where an employee was operating a "White Motor Corporation" (Model #: MA30H, S/N: 5300615, Employer ID #: 2) LP type forklift equipped with roll over protection (ROPS) while carrying a load of empty pallets and was not wearing the seatbelt. Abatement Note: Retrain employees on the safe use and operation of forklifts, and enforce the use of seatbelts while operating forklifts.
