Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: The employer does not ensure that employees were provided with training on procedures to follow in the event that their hydraulic lift failed and could not be lowered because the lift was mechanically held in place by contact with another object. This violation occurred on or about October 28, 2010, at a site located in an alley at 2312 North Main Street, Midland, Texas where at least one (1) employee engaged in an unsafe act as a result of this lack of training. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps taken to give training to employees operating aerial lifts, including additional training given to the operators of aerial lifts that consists of a combination of formal instruction in the use of fall protection, practical training, and a review of the employer's requirements for the use of aerial lifts.
