North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a) outside of the facility, an employee walking directly in front of the Valla Crane 75E, holding two, 8 ft slings, and was struck by the left wheel of the Valla crane, resulting in amputation of his left leg. Reference: VALLA 75E SERIAL NO.8400 - INSTRUCTIONS, MAINTENANCE, SPARE PARTS Manual, pg 13. Among other methods, feasible and acceptable abatement methods can include re- training employees in the following safety measures: (1) Never handle and/or move load above people, and (2)Never handle load above the working area and make sure nobody is in the crane and load operating area.
