Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:01/06/05 Condition:Employees elevated in the side bucket of a Labrie Top Select 2000 recycling truck, and who entered the body compartment(s) to rearrange recyclable materials, were not protected from hazards such as falling up to approximately 10 feet from the bucket or the 4 inch wide top rail; being dumped into the body compartment(s) from the bucket; being engulfed by the material in the compartment(s); or being crushed in the event that the maximizer cycled. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop, implement and enforce safe work practices and procedures for the operation and use of recycling trucks, and to strictly forbid employees from entering the body compartment(s), in accordance with the manufacturer's operator's manual. Abatement documentation (photographs, receipts, copies of programs, training certification, etc.) is required for this item.
