OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to ejection, struck-by and crushed-by hazards while operating riding lawnmowing equipment: A) Chris Glancy's Lawn Care Inc. on or about June 10, 2024 at the address of 875 N Hermitage Rd., Hermitage, PA: An employee operating the Ex Mark Lazer Zero Turn Lawn Mower serial number: 403127090 struck a metal water standpipe that was protruding from the ground and was ejected from the mower. The employee was not utilizing the operator seatbelt. B) Chris Glancy's Lawn Care Inc. on or about June 10, 2024 at the address of 875 N Hermitage Rd., Hermitage, PA: An employee was operating the Ex Mark Lazer Zero Turn Lawn Mower, serial number 403127090, without the discharge chute guard attached to the mower deck. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of the abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
