Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat: a) On or about and at times prior to June 23, 2023, employees were exposed to the hazard of high heat from direct sunlight during the performance of their duties, including residential concrete roof tile removal for 8 hours. The calculated Wet Bulb Globe Temperature (WBGT) ranged from 82.9? to 92? (28.3�C to 33.3�C) while working outdoors performing light to moderate manual labor and wearing short sleeve t-shirts and pants. An employee assigned to perform roof activities, such as, but not limited to roof tile removal and collection of debris experienced adverse health effects such as fatigue, and heat exhaustion from exposure to the hot work environment. As a result of the exposure, the employee was hospitalized and later was pronounced deceased.
