Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, in that, employees were exposed to the risk of being struck-by / crushed-by a hay bale not securely stacked: (a) Stinson Mushrooms, LLC, 670 McGovern Road, Hockessin, DE 19707: On or about and at times prior to August 3, 2022 , employee(s) removing tarps from hay bales, were exposed to being struck by cube-shaped (4 x 4 x 8 ft.) hay bales, each weighing up to 1600 pounds, that were not securely stacked, and in danger of collapse. Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
