Text For Citation: 01 Item/Group: 001 Hazard:
29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). (a) Jobsite : 11 Industrial Blvd, Paoli, PA: On or about February 23, 2022, an employee was struck-by a vehicle while operating a stand up mower, 60" Exmark Turf Tracer, with a Sulky attachment. The employer did not assess the hazards in the workplace nor created a traffic-control plan for employees working in or alongside active roadways. ABATEMENT NOTE: Among other feasible and acceptable methods to correct this hazardous condition would be, but are not limited to, the following: Create a Temporary Traffic Control plan which describes measures to be used for facilitating road users through a work zone as described in the Federal Highway Administrations Manual on Uniform Traffic Control Devices (MUTCD) 2009 edition, Section 6C.01. Follow the recommendations contained in the OSHA and Professional Landcare Network (PLANET) Alliance card on Roadside Safety. Comply with the National Organization of Landscape Professionals recommendations on Working Near Roadways.
