Text For Citation: 01 Item/Group: 001 Hazard:
29 CFR 1910.266(h)(1)(vi):Each danger tree shall be felled, removed or avoided. Each danger tree, including lodged trees and snags, shall be felled or removed using mechanical or other techniques that minimize employee exposure before work is commenced in the area of the danger tree. If the danger tree is not felled or removed, it shall be marked and no work shall be conducted within two tree lengths of the danger tree unless the employer demonstrates that a shorter distance will not create a hazard for an employee. On or about January 8, 2021, the employer did not ensure that each danger tree was removed by mechanical means before work was commenced. As an employee felled a leaning tree between two trees, it contacted one of the trees and caused it to be under pressure due to the tree bending. When the employee began to cut the tree to the required 16 foot length, the pressure was released and the felled tree sprang up and landed on the employee's right foot crushing multiple bones.
