OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while inspecting the content levels of the hopper railcars. On or about May 1, 2018, at 1950 Old State Highway 7 in Rayland, Ohio, an employee was checking the railcars contents levels was exposed to a fall over 10 feet from on top of the hopper railcar was not protected by a fall protection system.
