Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The possibility of broken bones, crushing and possible death resulting from the hazards of working with, on, and around rail cars which have safety appliance defects. These deficiencies included bent and broken ladders, defective uncoupling bars, and bent or defective brake wheels. Among other methods, one feasible and acceptable method to correct these hazards is to require all tagged or defective rail cars are repaired where they are found or if impossible that the car is moved only to a designated area for repairs and not moved or used until repairs are completed. All involved employees shall be reinstructed in these procedures and adhearance to these requirements shall be strictly enforced.
